Seal of Approval (Toy Testing) Program - Program Rules and Disclaimers

Effective Date: July 15, 2024

Welcome to Pediatric Toy Expert’s Children's Toy Seal of Approval (Testing) Program (the "Program"). Before participating, please carefully review and understand the following rules and disclaimers governing your participation in the Program:

Program Overview:

  1. A Program spans 11 weeks, during which submitted toys will be evaluated by pediatric experts. As on July 1, 2024, the program is now completed on an on-demand basis.

  2. Toy winners will be announced according to the schedule provided during the initial submitting process.

Expert Evaluation:

  1. Pediatric experts, including Speech-Language Pathologists, Occupational Therapists, Physical Therapists, and other qualified professionals, will assess each submitted toy.

  2. All pediatric experts are thoroughly vetted to ensure they possess the necessary credentials to evaluate children's toys.

Toy Evaluation Process:

  1. Each toy will undergo evaluation by multiple experts, who will complete detailed questionnaires.

  2. The questionnaires will be reviewed to determine whether a toy receives overall approval.

No Guarantee of Approval:

  1. Submitting a toy for consideration does not guarantee that it will receive a seal of approval from our experts.

  2. The subjective nature of toy evaluation may result in varying opinions among experts.

Winners' Benefits:

  1. Winners will receive a dated seal of approval specific to the winning toy, which may be used on packaging, marketing materials, or related items.

  2. A comprehensive report containing testing results and suggestions from each expert regarding the toy's use will be provided for marketing purposes.

  3. A blog post featuring the winning toy will be posted on our website.

Safety Disclaimer:

  1. While we strive to evaluate toys for their potential benefits in child development, we do not conduct safety certifications or inspections as part of this Program.

  2. Our seal of approval is not an endorsement of the toy's safety or compliance with any specific safety standards or regulations.

  3. It is the sole responsibility of toy manufacturers or companies to ensure their products meet all safety standards and certifications required by law.

  4. Participation in the Program does not relieve toy manufacturers or companies of their obligation to adhere to safety regulations and standards.

Limited Liability:

  1. The seal of approval provided by our Program does not make us liable for any safety issues, injuries, or incidents arising from the use of a specific toy.

  2. We are not responsible for ensuring that every toy has been tested properly to obtain proper certifications.

  3. Toy manufacturers or companies are solely responsible for the safety, compliance, and quality of their products.

  4. By participating in the Program, toy manufacturers or companies agree to indemnify and hold harmless the Program and its organizers from any liability related to their toys.

Expert Subcontractor Disclaimers:

  1. While we take measures to vet pediatric experts, we do not assume liability for the actions, conduct, or qualifications of subcontracted pediatric experts.

  2. Pediatric experts are required to disclose prior business associations with toy manufacturers or companies. If an expert has worked with a toy manufacturer or company in the past, they are prohibited from evaluating toys from that manufacturer or company in the Program.

  3. Pediatric experts are strictly prohibited from communicating with toy manufacturers or companies of the toys they evaluate during the program unless explicit permission is granted by the Program organizers.

Refund Policy:

  1. Submission fees are non-refundable regardless if a toy does not receive a seal of approval.

  2. Approval or disapproval of a toy is based on the subjective evaluation of our experts and does not guarantee commercial success.

Submission Steps:

  • Step 1: Submit your toy(s), pay the required fee, and complete the associated questionnaire(s). If you are submitting multiple toys, you may use code MULTIPLE20 for 20% your entire order.

  • Step 2: Upon successful submission, you will receive an email confirmation for the upcoming testing session.

  • Step 3: Prepare 5 free samples of your toy for our testers. Shipping instructions will be provided via email. Timely shipping is essential to avoid delays in the testing process. Any products received 20 days after the testing start date will have their results date pushed back to allow enough testing time.

  • Step 4: Await the email results.

By participating in the Children's Toy Testing Program, you acknowledge and agree to abide by these rules and disclaimers. Failure to comply may result in disqualification from the Program.

These terms and conditions are subject to change without notice. It is your responsibility to review these terms periodically for any updates or changes. These terms and conditions shall be governed by and construed in accordance with the laws of Wyoming.

Thank you for your participation, and we look forward to evaluating your toys for the benefit of children's development.
